ETD-019 – Intellectual Property Policy
Plain Language Summary
EmergencyTireDelivery.com (“ETD”) respects the intellectual property rights of providers, customers, business owners, content creators, and other third parties.
Marketplace participants retain ownership of the content they create and submit to the ETD Marketplace. By submitting content, participants grant ETD the limited rights necessary to display, promote, and operate the marketplace.
This Policy explains how intellectual property is treated within the ETD Marketplace.
1. Purpose
The purpose of this Policy is to protect intellectual property rights while allowing the ETD Marketplace to display and promote marketplace content in connection with its normal business operations.
2. Scope
This Policy applies to content submitted or displayed through the ETD Marketplace, including but not limited to:
- Business names
- Company logos
- Trademarks
- Service marks
- Photographs
- Videos
- Product descriptions
- Business descriptions
- Listing content
- Marketing materials
- Educational content
- Website content
3. Ownership of Submitted Content
Providers and other users retain ownership of the intellectual property they lawfully own.
Submitting content to the ETD Marketplace does not transfer ownership of that content to ETD.
4. Limited License to ETD
By submitting content to the ETD Marketplace, the submitting party grants ETD a non-exclusive, worldwide, royalty-free license to:
- Display marketplace listings
- Publish submitted content
- Promote marketplace listings
- Display photographs and logos
- Improve marketplace functionality
- Market the ETD Marketplace and its services
This license exists solely for operating, promoting, and improving the ETD Marketplace and does not transfer ownership of the submitted content.
5. Provider Responsibilities
Providers are responsible for ensuring they have the legal right to use and submit any content uploaded to the ETD Marketplace.
Providers should not upload content that infringes the intellectual property rights of others.
6. ETD Intellectual Property
Unless otherwise indicated, the following may constitute intellectual property owned by or licensed to ETD:
- ETD trademarks
- EmergencyTireDelivery.com branding
- ETD logos
- Website design
- Marketplace organization
- Original ETD graphics
- Original ETD educational materials
- Original ETD publications
- Original ETD software and platform features
These materials may not be copied, reproduced, distributed, or used without appropriate authorization, except as permitted by applicable law.
7. Respect for Third-Party Rights
ETD encourages all marketplace participants to respect the intellectual property rights of others.
The unauthorized use of copyrighted works, trademarks, logos, photographs, or other protected materials is inconsistent with ETD Marketplace Standards.
8. Intellectual Property Concerns
Individuals or organizations who believe that content displayed through the ETD Marketplace infringes their intellectual property rights may notify ETD.
When appropriate, ETD may review the matter and take reasonable action consistent with applicable law and ETD policies.
9. Removal of Content
ETD reserves the right to remove or restrict access to content that reasonably appears to:
- Infringe intellectual property rights
- Violate ETD policies
- Violate applicable law
- Misrepresent ownership or authorization
10. Marketplace Promotions
ETD may feature marketplace listings, provider logos, photographs, and publicly available listing information in advertisements, educational materials, newsletters, social media, search results, and other promotional materials relating to the ETD Marketplace.
Such use is intended solely to promote the marketplace and its participating providers.
11. Termination of Marketplace Participation
Upon termination of marketplace participation, ETD may discontinue displaying the participant’s listings and marketplace content within a reasonable period, subject to applicable legal, operational, archival, or recordkeeping requirements.
This does not affect ownership of the participant’s intellectual property.
